Rules for Filing & Grounds for Divorce – Texas

In Texas, you may file for divorce if you or your spouse have resided in the state for at least six months prior to filing and have lived in the county where you intend to file for the preceding 90-day period.

A divorce may be "no fault" meaning neither spouse blames the other for the failure of the marriage. If, however, you file a divorce petition that declares fault, you must substantiate through evidence or testimony the grounds on which the divorce is to be granted.

Grounds for divorce in Texas may be any of the following

  • Cruelty
  • Adultery
  • Abandonment
  • Living apart for at least three years
  • Confinement in state mental hospital
  • A felony conviction or long term imprisonment (more than one year)
